Nursery terms

Last updated 8 October 2026.

These terms apply to nurseries that list plants on Midstorey, run by the operator of this site ("we"), and to featured placement. They add to our terms of use. "You" means the nursery and the people it lets use the portal.

1. Joining

Listing is free. We check applications and may decline any. You're responsible for the people you give portal access to; tell us when someone should lose access.

2. Your listings

  • Keep them accurate: the right plant, a working link to your own product page, and current prices and stock. Mark plants out of stock rather than leaving them listed as available.
  • Prices you show must be the full price a customer pays, including GST, as the Australian Consumer Law requires.
  • Only list plants you can lawfully sell and send. Don't list declared weeds or other restricted plants, and only say you deliver to states whose biosecurity rules allow you to send those plants there.
  • You give us a free, non-exclusive licence to show your nursery's name, description, website and listings on the site while you're listed.

We may correct or remove listings that look inaccurate or break these terms, and will tell you when we do.

3. Click reports

Click reports count visits that went through our links to your site. They're a useful guide but may differ from your own website statistics. They don't identify visitors; please don't try to.

4. Featured placement

What you get: your listings are shown first among nurseries that deliver to the visitor's state on plant pages, and preferred when several nurseries are equally good choices in a gardener's list shopping plan. Featured listings are labelled "Featured", and the site explains that featured nurseries pay for placement. Featuring never changes plant information or hides other nurseries. We can't promise any number of clicks or sales.

Price and billing: $49 a month, charged in advance each month through Stripe, renewing automatically until you cancel. Stripe provides your receipts.

Cancelling: cancel at any time from the featured placement page in the portal. You stay featured until the end of the month you've paid for. We don't refund part months, except where the law requires it or where we end featured placement without you having broken these terms, in which case we refund the unused part.

Price changes: we'll give you at least 30 days' notice by email, and you can cancel before the new price applies. If a payment fails, Stripe will retry it; if it isn't paid, featured placement ends.

5. Ending

You can stop listing at any time: remove your listings in the portal, or email us to remove your nursery. We may suspend or remove a nursery that seriously or repeatedly breaks these terms, after telling you why and, where reasonable, giving you a chance to fix it. We may also stop offering listings or featured placement altogether with at least 30 days' notice, refunding any unused featured placement.

6. Responsibility

Nothing in these terms limits rights you have under the Australian Consumer Law that can't be excluded. Apart from those rights, and to the extent the law allows, our total liability to you for featured placement is limited to the amount you paid us for it in the previous 12 months, and neither of us is liable to the other for indirect losses such as lost profits.

7. Changes

We'll give at least 30 days' notice by email of significant changes to these terms. If you don't agree, you can cancel featured placement or stop listing before the change takes effect.

8. Law

These terms are governed by the law of the Australian state or territory where the operator is based, Australia.
