Terms of use

Last updated 8 October 2026.

These terms apply when you use Midstorey, run by the operator of this site ("we"). By using the site you agree to them. Nurseries listing plants also agree to our nursery terms.

1. Plant information is a guide

We work hard to make plant information accurate, but plants vary, and so do gardens, regions and sources. Some information is drafted with the help of AI tools or contributed by members of the community, and is checked by moderators, but mistakes are possible. Before planting:

  • check whether a plant is toxic or hazardous if children or pets will be near it;
  • check with your local council or state authority whether a plant is a weed in your area, especially near bushland;
  • don't rely on this site for bush food identification, medical or safety decisions.

"Native near your postcode" results are based on records of where plants have been found, which include some planted and escaped plants and miss some places. Treat them as a strong guide, not a survey.

2. Accounts

You need to be 16 or older to make an account. Give a real email address, keep your password to yourself, and tell us if you think someone else has used your account. You're responsible for what's done with your account.

3. Your lists

Private lists are only for you. If you share a list by link or make it public, anyone who can see it can view and copy it, and public lists can appear in search engines. Don't put personal information in a list you share.

4. Your contributions

When you suggest changes, suggest a plant or upload a photo, you confirm that you're allowed to share it, and that it's not copied from somewhere that doesn't allow it. Facts are fine to share; copying someone else's wording or photos without permission isn't.

  • Plant information you contribute (text and data): you give us a permanent, worldwide, free, non-exclusive licence to use, edit, combine, publish and share it as part of the database, including allowing others to use the database.
  • Your own photos: you keep the copyright. You give us a permanent, worldwide, free, non-exclusive licence to show the photo on the site and in material promoting the site, with the credit you gave. You agree to us resizing, cropping or converting it so it displays well, and to it being shown alongside advertising or nursery listings. If the photo shows people, you confirm they're happy for it to be published.
  • Openly licensed photos (Creative Commons) are used under their licence, with the credit and link it requires.

We decide what's published, may edit contributions for accuracy or style, and may remove anything at any time. Approved contributions stay in the database if you later delete your account.

5. Using the site fairly

Please don't: post anything unlawful, misleading, offensive or that infringes someone's rights; use the site to advertise or spam; get around limits or security measures; or collect information about other users. Reasonable automated access is fine if it doesn't strain the site and respects robots.txt; large-scale copying of the database isn't. We may suspend or close accounts that break these terms.

6. Buying plants

Nurseries listed on the site are independent businesses. When you buy from one, your purchase is between you and that nursery, on its terms, and your consumer rights are against the nursery. Prices, stock and delivery can change, so check on the nursery's site. Some states restrict plants coming from other states; check that a nursery can legally send to you.

7. How the site is paid for

Some nursery links are referral links that may earn us a fee, and nurseries can pay to be featured. Both are labelled where they appear. Payment never changes plant information. See how we're funded.

8. Other people's content and data

The site uses information from the Atlas of Living Australia and its data providers, postcode locations from GeoNames, and openly licensed photos (mostly from Wikimedia Commons), each under its own licence and credited where used. Links to other websites are for your convenience; we're not responsible for their content.

9. Our responsibility to you

You have rights under the Australian Consumer Law that can't be excluded, and nothing in these terms limits them. Apart from those rights, the site is provided as it is, free of charge, and we don't promise it will always be available or error-free. To the extent the law allows, we're not liable for loss arising from relying on plant information or from buying from nurseries listed on the site.

10. Changes

We may update these terms. For significant changes we'll give account holders at least 30 days' notice by email. If you don't agree with a change, you can delete your account before it takes effect.

11. Law

These terms are governed by the law of the Australian state or territory where the operator is based, Australia.
